Terms of Use

These Terms of Use (“Terms”) are a legally binding agreement between you and ZimanGo LTD (“ZimanGo”, “we”, “us”, “our”) governing your access to and use of the ZimanGo mobile apps (iOS and Android), our website, and related services (together, the “Service”). Please read them carefully.

1. Agreement & changes to these Terms

These Terms apply each time you access or use the Service. We may update them from time to time — for example, to reflect changes to the Service or the law. If we make material changes, we will post the updated Terms here, update the “Last updated” date, and, where appropriate, notify you in the app. Changes take effect when posted (or on any later date we state). By continuing to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you should stop using the Service.

2. Who can use ZimanGo

To use the Service, you must be at least 13 years old, or the minimum age of digital consent in your country if that is higher. If you are under the age of majority where you live, you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

3. Your account

You can start learning as a guest, but some features require an account. When you register, you agree to provide accurate and complete information and to keep it up to date. You are responsible for your account and for all activity that happens under it, and for keeping your password and login details confidential. Please notify us promptly at help@zimango.app if you believe your account has been accessed without your permission. We are not responsible for losses caused by unauthorised use of your account resulting from your failure to keep your credentials secure.

4. Licence to use the app

Subject to these Terms, ZimanGo grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use the app on a device you own or control, solely for your own personal, non-commercial learning. You must not:

  • Copy, reproduce, distribute, publicly display or create derivative works from the Service, except as expressly allowed;
  • Reverse-engineer, decompile, disassemble or attempt to derive the source code of the app, except to the extent this restriction is prohibited by law;
  • Rent, lease, sell, sublicense or otherwise transfer your rights in the app;
  • Remove or alter any proprietary notices, or use the Service in any way not permitted by these Terms.

5. Subscriptions & billing

ZimanGo is free to use with ads. We also offer optional paid subscriptions (for example, weekly, monthly and yearly plans) that unlock premium features such as an ad-free experience and additional tools and rewards.

  • Billing through the app stores. Subscriptions are sold and processed by the Apple App Store or Google Play, depending on your device. Payment is charged to your Apple or Google account, and those stores' terms apply to the transaction. We do not process or store your card details.
  • Auto-renewal. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Managing & cancelling. You can view, manage or cancel your subscription at any time in your Apple ID or Google Play account settings. Cancelling stops future renewals; you keep premium access until the end of the period you have already paid for.
  • Free trials & offers. If a plan includes a free trial or introductory offer, any unused portion is forfeited when you purchase a subscription, where applicable. Unless you cancel before a trial ends, it converts into a paid subscription.
  • Prices & changes. Prices may vary by country and may change over time. We will not change the price of an existing subscription period you have already paid for; price changes apply to future renewals in line with the app stores' rules.
  • Refunds. Purchases are generally non-refundable except where required by law. Because payments are handled by Apple or Google, refund requests are subject to their policies and must usually be made to them directly. Nothing in these Terms limits any statutory rights you may have as a consumer.

6. In-app rewards & virtual items

The Service may include virtual items and rewards — such as in-app currency, points, streak items, badges or similar features — that you earn or unlock while learning. These items have no monetary value, cannot be exchanged for cash or transferred outside the Service, and are licensed to you, not sold. We may manage, adjust, regulate or remove virtual items at any time, and we are not liable to you for doing so.

7. Your content

The Service may let you create or share content — such as quotes, comments, reactions, a profile photo and bio, images and audio (“User Content”). You keep ownership of your User Content. By submitting User Content, you grant ZimanGo a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, use, reproduce, adapt, publish, translate and display that content for the purpose of operating, providing and improving the Service. This licence ends when you delete your User Content, except where it has been shared with others who have not deleted it, or where we must retain it to comply with the law.

You are responsible for your User Content and represent that you own it or have the rights to share it, and that it does not infringe anyone's rights or break the law. You must not post content that is unlawful, infringing, defamatory, hateful, harassing, obscene, deceptive, or that violates our Community Guidelines. We may review, moderate, refuse, restrict or remove User Content, and suspend accounts, at our reasonable discretion — for example, where content breaches these Terms.

8. Acceptable use

We want ZimanGo to be a positive and safe place to learn. You agree not to:

  • Use the Service for any unlawful, harmful, fraudulent or abusive purpose;
  • Harass, bully, threaten, impersonate or infringe the rights of others;
  • Upload viruses or malicious code, or attempt to interfere with, disrupt or overload the Service;
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems, or circumvent security or usage limits;
  • Use bots, scrapers or other automated means to access, copy or collect content or data from the Service without our permission;
  • Cheat, manipulate leaderboards, leagues or rewards, or use the Service in a way that harms other users or ZimanGo.

9. Intellectual property & brand protection

Our rights. The Service and everything in it — including the ZimanGo lessons and learning content, text, translations, graphics, illustrations, the lion-cub mascot and all character art, animations, sound effects and music, software and source code, databases, and the overall design, layout, structure, “look and feel”, and the selection and arrangement of content (together, “ZimanGo Content”) — are owned by ZimanGo LTD or its licensors and are protected by copyright, trademark, database, design and other intellectual-property rights worldwide. Except for the limited, personal licence in Section 4, no rights are granted to you, and all rights are reserved.

Trademarks & brand. “ZimanGo”, the ZimanGo logo, the lion-cub mascot, our brand colours and visual identity, our taglines, and our product and feature names are trademarks and brand elements of ZimanGo LTD, whether or not registered. You may not use them — or any name, logo, colour scheme, design or mark that is identical or confusingly similar — without our prior written permission, including:

  • in the name, icon, branding, screenshots or store listing of any app, website, product or service;
  • in advertising, marketing, promotion, sponsorship or endorsements, or in any way that suggests you are affiliated with, endorsed by, or the source of ZimanGo, or that ZimanGo is the source of your product or content;
  • in domain names, social-media handles, account or user names, or as search-engine keywords or paid-advertising terms;
  • on merchandise, or in any comparative, competitive or “powered-by” marketing.

No copying, cloning or imitation. You must not copy, reproduce, imitate, adapt, translate, republish, distribute, sell, decompile, reverse-engineer or scrape the ZimanGo Content. You must not build, publish, operate or promote any app, website, product or service that copies or imitates the ZimanGo Content, our design, look and feel, user interface, artwork, sounds or brand, or that is otherwise likely to confuse users into believing it is, or is connected with, ZimanGo. You must not use any automated means (bots, scrapers, crawlers, or similar) to access, copy or extract the Service, its content, assets or data.

Enforcement. ZimanGo LTD actively protects its intellectual property and brand. Any unauthorised use is a breach of these Terms and may also infringe our rights under applicable law. We reserve the right to take all steps we consider appropriate — including content removal, account termination, and legal proceedings seeking injunctions, damages, an account of profits, delivery-up or destruction of infringing materials, and recovery of our legal costs — to the fullest extent permitted by law. If you become aware of any misuse of our name, logo, assets, content or brand, please report it to help@zimango.app.

10. App stores & third-party services

The Service relies on third-party services (such as Google Firebase and other providers) and is distributed through the Apple App Store and Google Play. We are not responsible for those third parties or their terms, and your use of them may be subject to their own agreements.

Apple App Store. If you download the app from the Apple App Store, you acknowledge that these Terms are between you and ZimanGo only, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the extent permitted by law, Apple has no warranty obligation for the app, and any claims relating to the app (including product-liability, legal-compliance or consumer-protection claims) are our responsibility, not Apple's. You agree to comply with the App Store Terms of Service, and you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play. If you download the app from Google Play, your use is also subject to the Google Play Terms of Service.

11. Advertising

The Service may show advertising to users on the free plan, delivered by Google AdMob and its partners. Premium subscribers do not see ads. You can manage ad-personalisation choices in the app and through your device settings, as described in our Privacy Policy. We are not responsible for the content of third-party ads or the products and services they promote.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis. While we work hard to provide a high-quality learning experience, we do not warrant that the Service will be uninterrupted, error-free or secure, or that content (including translations, dictionary-style entries or user content) will always be accurate or complete. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

13. Limitation of liability

To the maximum extent permitted by law, ZimanGo will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of profits, data, goodwill or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. Our total liability to you for all claims relating to the Service in any twelve-month period will not exceed the greater of the amount you paid us for the Service in that period or £50 (GBP). Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. If you are a consumer, you have legal rights that these Terms do not affect.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless ZimanGo and its directors, officers, employees and agents from any claims, losses, liabilities and reasonable expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Service, your User Content, or your violation of any law or the rights of a third party.

15. Suspension & termination

You may stop using the Service and delete your account at any time from the app Settings. We may suspend or terminate your access to the Service, or remove content, if you breach these Terms or our Community Guidelines, if required by law, or to protect the Service or other users. Where reasonable, we will give you notice. On termination, your licence to use the Service ends, and we may delete your account and associated data, except where we need to retain it as described in our Privacy Policy or by law. Provisions that by their nature should survive termination (such as content licences you granted, intellectual-property terms, disclaimers, limitation of liability, indemnification and governing law) will continue to apply.

We respect intellectual-property rights and expect our users to do the same. If you believe that content on the Service infringes your copyright or other rights, please email help@zimango.app with: (a) a description of the work you say has been infringed; (b) a description and location of the allegedly infringing content on the Service; (c) your contact details; (d) a statement that you have a good-faith belief the use is not authorised by the rights holder, its agent or the law; and (e) a statement that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf. We will review valid notices and may remove or disable access to the content concerned.

17. Governing law & jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Service, are governed by the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in another country, you benefit from any mandatory protections of the law of your country of residence, and you may also be able to bring proceedings in your local courts.

18. General

  • Entire agreement. These Terms and the documents referred to in them (including our Privacy Policy and Community Guidelines) are the entire agreement between you and ZimanGo regarding the Service.
  • Severability. If any provision is found unenforceable, the rest of the Terms remain in effect, and the unenforceable provision will be limited or removed to the minimum extent necessary.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not transfer your rights under these Terms without our consent. We may assign our rights and obligations, for example as part of a merger, acquisition or sale of assets.
  • Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
  • Language. These Terms were written in English. Any translation is provided for convenience; if there is a conflict, the English version prevails.
